FERC staff recommends against Bear River dam

Staff of the U.S. Federal Energy Regulatory Commission have recommended against licensing a dam, reservoir, and hydropower project proposed for the Bear River near Preston, Idaho.

The case involves a 2013 application by Twin Lakes Canal Company to the FERC for a license to construct, operate, and maintain the Bear River Narrows Project.  The project would be located on the main stem of the Bear River in Franklin County, Idaho, about 9 miles northeast of the city of Preston. It would feature a 109-foot-high dam impounding a 362-acre reservoir, and a powerhouse with an installed capacity of 10 megawatts and estimated average annual generation of of 48,531 megawatt-hours of electricity.  The reservoir would also be used to provide up to 5,000 acre-feet of water to Twin Lakes’ irrigation system during dry years.

Under the Federal Power Act, the FERC is charged with processing licenses for most hydropower projects in the U.S.  Federal law guides the FERC in this duty.  Sections 4(e) and 10(a)(1) of that act require the Commission to give equal consideration to the power development purposes and to the purposes of energy conservation; the protection of, mitigation of damage to, and enhancement of fish and wildlife; the protection of recreational opportunities; and the preservation of other aspects of environmental quality.  The Commission can only issue licenses that in its judgment are best adapted to a comprehensive plan for improving or developing a waterway or waterways for all beneficial public uses.  Additionally, the National Environmental Policy Act of 1969 requires the agency to analyze and document the environmental effects of proposed federal actions such as granting Twin Lakes' application.

Commission staff released its final environmental impact statement on Twin Lakes' license application on April 27, 2016.  That document, called an EIS, analyzes the effects of proposed project construction and operation, and recommends conditions for any license that may be issued for the project.

In the Bear River Narrows Project EIS, FERC staff considered Twin Lakes’ proposal for licensing, as well as three alternatives: (1) no-action (i.e. not licensing the project, so it can't be constructed); (2) the applicant’s proposal with staff modifications (staff licensing alternative); and (3) the staff licensing alternative with an additional condition requested by the Bureau of Land Management.

The EIS notes the existence of four Commission-licensed hydroelectric facilities located on the Bear River in Idaho with a combined installed capacity of more than 78 MW, including the Oneida development directly upstream.  It also notes uses of the "Oneida Narrows" section of the Bear River that would be flooded by the Bear River Narrows Project impoundment, including a recreational trout fishery and boating opportunities, and habitat for sensitive wildlife species.

Based on a review of the anticipated environmental and economic effects of the proposed project and its alternatives, as well as the agency and public comments filed on this project, staff recommends no action (license denial) as the preferred alternative.  In staff's words, "The overall, unavoidable adverse environmental effects of both action alternatives would outweigh the power and water storage benefits of the project."

For these reasons, FERC staff concluded that "any license issued for the proposed project could not be best adapted to a comprehensive plan for improving or developing the Bear River for all of its beneficial public uses, especially its substantial public recreation use at the proposed project site. We, therefore, recommend license denial."

Twin Lakes Canal Company's application to the Commission for a license to construct the project remains pending.

Atlantic offshore wind energy targeted

A report released by the National Wildlife Foundation highlights the potential of U.S. states on the Atlantic Ocean to generate electricity from offshore wind -- and calls upon state leaders to take action to promote offshore wind development.

The 24-page report, Catching the Wind: State Actions Needed to Seize the Golden Opportunity of U.S. Offshore Wind Power, describes responsibly developed offshore wind as "a golden opportunity to meet our coastal energy needs with a clean, local resource that will spur investments in local economies."  In particular, the Atlantic coast offers a high-quality wind resource in close proximity to power-thirsty coastal cities.

Key findings in the report include:
The report highlights Massachusetts and Rhode Island as leading America's pursuit of offshore wind, followed by Maryland, Virginia, New York, New Jersey, and Delaware, with Maine, North Carolina, South Carolina, and Georgia bringing up the rear.  New Hampshire, Connecticut, and Florida are noted as "states to watch" with no offshore wind planning activities.

The report calls on state leaders to:
  • Set a bold goal for offshore wind in the state's energy plan.
  • Take action to ensure a competitive market for offshore wind power.
  • Advance power contracts for offshore wind.
  • Ensure an efficient, transparent, and environmentally responsible offshore wind leasing process that protects wildlife.
  • Invest in key research, initiatives, and infrastructure needed to spur offshore wind development.

EnergyOcean International 2012

This week I am attending EnergyOcean International 2012, the ninth annual conference for the offshore renewable energy sector.

This morning's keynote address was delivered by Tommy Beaudreau, Director of the Bureau of Ocean Energy Management. Director Beaudreau gave an overview of BOEM and how its Office of Renewable Energy Programs fits in with other responsibilities like offshore oil and gas leasing and regulation.

Upcoming presentations include a discussion of global offshore renewable energy development, marine spatial planning, best practices for managing interactions between wildlife and offshore projects, an update on what's happening with wave and tidal energy, and a review of successful project finance strategies.

Concerns about environmental impacts play a big role in energy policy decisions.  Concerns over the impacts of running traditional fossil-fueled generation helped create a market for renewable power.  At the same time, concerns about the local impacts to wildlife of siting a particular renewable project can make the project cost-prohibitive or even impossible.

BrightSource Energy has been building a large solar power project in California's Mojave Desert.  Construction of Phase I of the 392 MW Ivanpah solar project broke ground in October 2010, with two subsequent phases slated for development shortly thereafter.  As construction progressed, the developer ran into tortoises at the site -- more tortoises than were assumed when the project got a key approval from the federal Fish and Wildlife Service.  In April 2011, BrightSource was advised by the U.S. Bureau of Land Management that BrightSource needed a revised biological opinion from the Fish and Wildlife Service that the project development wouldn't harm the threatened desert tortoise.  BrightSource stopped construction of units 2 and 3 of the project.


Now, BrightSource is back to work.  Last week, the Fish and Wildlife Service issued a biological opinion that the project will not endanger tortoises, provided that a list of stipulations are followed: ranging from relocating tortoises and predator protections, to fencing and an employee environmental awareness program.
 

This story illustrates an example of how concerns over environmental quality shape energy policy.  For project developers and wildlife defenders alike, it also suggests that we have ways to balance competing environmental concerns such as tortoises and clean renewable energy.

Renewable energy is touted as helping the environment -- but project development can be halted due to concerns about wildlife impacts.  In today's news, a 39-turbine wind project in Maine has withdrawn a key state land use application due to agency concerns over the project's impacts on wildlife.

Highland Wind LLC had proposed a 117 megawatt wind energy development to be located on Stewart Mountain, Witham Mountain, Bald Mountain, Briggs Hill, and Burnt Hill in Highland Plantation and Pleasant Ridge Plantation, Somerset County.  As initially conceived, the project would consist of approximately 39 wind turbines, plus access roads, interconnection facilities including a 34.5 kV collector line, substation, and 115 kV transmission line, and an associated outbuilding.

Two weeks ago, the Maine Department of Inland Fisheries and Wildlife issued findings that the project could impact habitat for threatened and endangered species including the northern bog lemming and the Roaring Brook mayfly.  Now, Highland Wind has withdrawn its application to allow it time to evaluate these impacts.

This isn't the first renewable project to be halted due to wildlife concerns.  Last week, BrightSource Energy put the development of phases 2 and 3 of its 392 megawatt Ivanpah solar project on hold due to impacts on the endangered desert tortoise.

Two weeks ago, I noted Google's investment in the 392 MW Ivanpah solar project in California's Mojave Desert, and how it benefited from $1.6 billion in Department of Energy loan guarantees.  Developer BrightSource Energy started construction on Phase I of the Ivanpah project in October 2010, with two subsequent phases slated for development shortly thereafter.  BrightSource's business plan also includes an initial public offering, which led the company to file an S-1 securities registration with the U.S. Securities and Exchange Commission.

The Ivanpah project has now hit a speedbump in the form of a tortoise.  The desert tortoise (Gopherus agassizii) lives in the Mojave desert, including in the area where the Ivanpah project is proposed.  As a result, BrightSource has apparently stopped work on the construction of Ivanpah's second and third phases.

BrightSource noted in its S-1 filing that "in April 2011, the U.S. Bureau of Land Management, or BLM, advised us that it will require the issuance of a revised biological opinion by the U.S. Fish & Wildlife Service, or FWS, prior to providing permission to proceed with the construction of Ivanpah’s second and third phases".

The Fish and Wildlife Service is reportedly developing that opinion now, which should be finalized over the summer.
